HIPLAY — Legal
Terms of Service
1. Acceptance
By downloading, installing or playing a HIPLAY game, or by using this website, you agree to these Terms of Service. If you do not agree, do not use the games or the website. If you are under the age at which you can form a binding contract in your country, a parent or guardian must accept these terms on your behalf.
2. Who we are and what these terms cover
These terms are an agreement between you and Shenzhen Zhaiyou Software Technology Co., Ltd., located in Shenzhen, Guangdong, China, which publishes games under the HIPLAY brand. They cover our mobile games distributed through digital stores — currently Epic Ragdoll Battle Simulator — and this website. Together they form the end-user licence terms for our games.
3. Licence to use
Subject to your compliance with these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download, install and play our games on devices you own or control, for your own private, non-commercial entertainment.
The games are licensed, not sold, to you. We reserve all rights not expressly granted. This licence ends automatically if you breach these terms.
4. Accounts
Our games do not require an account. You play without registering, signing in or giving us your name or email address. If we ever introduce optional accounts, we will explain the terms that apply to them before you create one.
5. Virtual items, currency and purchases
Our games may offer virtual items or currency, purchased with real money through Google Play Billing. When you buy:
- the transaction is processed by Google, and Google's payment terms and refund policies apply;
- virtual items are licensed to you under the same limited licence as the game — they are not yours to sell, trade or transfer;
- virtual items have no real-world cash value and cannot be exchanged for money or goods;
- except where required by law or by the store's refund policy, virtual purchases are final and non-refundable. Refund requests are handled through Google Play's refund process;
- if a purchase is charged but not delivered, contact us and we will make it right or point you to the store remedy.
6. Advertising
Our games contain advertisements, which is one of the ways they stay free to download. Ads are delivered by third-party networks and are not under our direct control.
We are not responsible for the content of third-party advertisements, but we do act on reports: if you see an ad that is offensive, misleading or inappropriate, tell us at [email protected] with a screenshot, and we will raise it with the network and work to have it blocked from our games.
7. Acceptable use
You agree not to:
- cheat, hack or exploit bugs to gain an unfair advantage;
- reverse engineer, decompile or disassemble the game, except where such restriction is prohibited by law;
- use the game or its content commercially without our written permission;
- interfere with the game's operation, servers or other players;
- use the game in any unlawful way or to create unlawful content.
Breaking these rules can lead to revocation of your licence and, where relevant, action under law.
8. Intellectual property
The games, including their code, art, sound, design and text, and the HIPLAY and Epic Ragdoll Battle Simulator names and marks, are owned by Shenzhen Zhaiyou Software Technology Co., Ltd. and protected by copyright, trademark and other laws. Your rights to them are limited to the licence in section 3. You may not use our trademarks — including in app names, domain names or marketing — without our prior written permission.
9. Third-party services
The games and this website rely on third-party services: the store you downloaded a game from, advertising networks, analytics providers and device maker services. Those services are governed by their own terms and privacy policies, and we are not responsible for them. A current list of the providers we integrate is in our Privacy Policy, section 5.
10. Availability and changes
We may update, patch, modify or discontinue a game or any part of it. Online-dependent features — for example advertisements, analytics-driven balancing or any server-side content — may change or stop as platforms and providers evolve. If we discontinue a game entirely, we will say so on this website. Virtual items in a discontinued game cannot be exchanged for money.
11. Disclaimer of warranties
The games and this website are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the games will be uninterrupted or error-free. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, Shenzhen Zhaiyou Software Technology Co., Ltd. will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, progress or virtual items, arising from your use of or inability to use the games or this website. Our total liability for direct damages is limited to the amount you paid us for the game in the six months before the claim (or ten US dollars if you paid nothing).
Nothing in these terms limits rights you have as a consumer that cannot be waived under the law of your country of residence, including mandatory consumer protections in the European Union, the United Kingdom, the EEA and US states.
13. Termination
You can stop using a game at any time by uninstalling it. We may suspend or terminate your licence if you seriously or repeatedly breach these terms, or where required by law or a store's policy. Sections 8, 11 and 12 survive termination.
14. Governing law and disputes
These terms are governed by the laws of the People's Republic of China, and the courts of Shenzhen, China have jurisdiction over disputes, except where the law of your country of residence gives you the right to bring claims locally. Nothing in this section deprives you of the mandatory consumer protections of your country of residence, including those under EU, UK, EEA and US state law. Before resorting to formal action, tell us about the problem — most disputes are solved faster over email.
15. Changes to these terms
We may change these terms as our games and the law evolve. The current version is always on this page with its "Last updated" date. Material changes will be highlighted on this website or in the game before they take effect. Continuing to use a game after a change takes effect means you accept the updated terms; if you do not accept them, stop using the game.
